Privacy Policy
This PIXELPAD.IO Privacy Policy describes how PIXELPAD.IO ("PIXELPAD.IO," "our," "we," "us,") collects and processes personal data that users (“user,” “your,” or “you”) provide to us at any of our websites where this Policy is posted (the “Sites”).
Treatment of Data for Minor Youth
We protect the privacy of children under the age of 13, residing outside of the European Union, within the spirit of COPPA, and those residing in the European Union as provided by the European Union General Data Protection Regulation (GDPR).
Youth under the age of 13 are not permitted to create accounts or provide personal data on our Sites without the consent of a parent, guardian or school. A school may provide that consent on behalf of a parent or guardian for accounts its students create at its direction, as described in section 15.
If we learn that we have personal data obtained directly from a child under 13 without such consent we will delete that data as soon as possible.
- Agreement to the Policy
By accessing or using any of our Sites, you agree to be bound by all of the Sites’ terms and conditions including this Privacy Policy. If you do not agree to any of the Sites’ terms and conditions or this Privacy Policy, please do not access or use any of our Sites in order to avoid inadvertent data collection.
- What personal data does PIXELPAD.IO Collect:
In the instances and for the reasons outlined in section 4, PIXELPAD.IO collects only the information needed to run your account and the Sites: email address; the nickname you choose for your account; the projects, code, images and text you create on the Sites; the messages you send to the AI learning assistant; and your Internet Protocol (“IP”) address and browser details, which are used for security and traffic monitoring and are not stored with your account. Teachers who create a teacher account also provide the name of their school. Projects are public: each project has a public page that shows your nickname, and projects may appear in the Explore gallery.
- How does PIXELPAD.IO collect the data:
We collect data when you provide it to us directly and by “cookies” (as described in section 9, below). You provide data to us when you: (a) create an account; (b) create, save or publish a project; (c) use the AI learning assistant; or (d) make a purchase. Your IP address and browser details are received automatically whenever you use the Sites.
- How does PIXELPAD.IO use the data:
By entering personal data into PIXELPAD.IO Sites or providing it to PIXELPAD.IO, you agree to allow PIXELPAD.IO to collect and use the data for the following purposes:
- To provide the service: to operate your account, save and load your projects, show your projects on their public pages and in the Explore gallery, and provide the AI learning assistant.
- To process purchases: to complete and record purchases you make on the Sites.
- To secure the Sites: to detect and block abuse, automated traffic and attacks.
- To measure and improve the Sites: to understand how the Sites are used, in aggregate, and to diagnose problems.
- How long does PIXELPAD.IO retain data:
PIXELPAD.IO will retain your data for as long as needed or permitted to fulfill the purposes and uses described in this Policy. When we no longer need your data, and there is no need to keep it to comply with our legal obligations or protect our legal rights, we will either delete it from our systems or depersonalize it so we can’t identify you.
If you wish to understand how to request your personal data be deleted, please refer to article 13 for more information.
- How does PIXELPAD.IO share data:
PIXELPAD.IO does not rent or sell data to others. Personal data is shared with the following service providers, which operate the Sites: Amazon Web Services (hosting and file storage), NexusHud, Anthropic and xAI (the AI learning assistant), Stripe (payments), and Google (site analytics and advertising).
- Except as otherwise provided in this Privacy Policy, PIXELPAD.IO will keep your personal data private and will not share it with third parties, unless such disclosure is necessary to: (a) comply with the law or legal process served on us; (b) provide you the products, services and/or information that you may have requested; (c) protect our rights or property; (d) enforce our rights; (e) protect the interests of users of the Site or any other person; (f) operate or conduct maintenance and repair of our equipment; (g) detect, prevent and/or otherwise address fraud, security or technical issues, as authorized by law; and/or (h) otherwise comply with applicable laws.
- How does PIXELPAD.IO protect information:
PIXELPAD.IO uses technical and organizational measures to protect data including, but not limited to: a web application firewall, security patching of our systems, request logging, and ensuring that all web connections are over HTTPS. Access to personal data is available through your user identification and password selected by you. This password is stored as a hash. Access to personal data is restricted to PIXELPAD.IO personnel who require it to operate the Sites.
- Cookies:
When you use any of our Sites, we store cookies on your computer. A cookie is a small text file that a website stores on your computer and later retrieves. Our cookies keep you logged in to the Sites. Google Analytics and Google AdSense place their own cookies on your computer. You may block or delete cookies in your browser settings, but you cannot stay logged in to the Sites without them.
- Privacy Policies of Third-Party Sites:
We may maintain links to other websites on our Sites. This Privacy Policy only applies to PIXELPAD.IO. Other sites accessible through our Site have their own privacy policies and data collection use and disclosure practices. Please consult each site’s privacy policy.
- How you can rectify incorrect information:
You may access and edit the personal data you provide to us at any time from your account settings.
- How you can object to certain uses of your data:
You have choices with respect to cookies, as described in section 9.
- How you can exercise your right to be forgotten:
You may delete your account at any time.
- Changes to this Privacy Policy:
We reserve the right to change this Privacy Policy at any time. Such changes, modifications, additions, or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting the revised Privacy Policy at any of our Sites. You acknowledge and agree that it is your responsibility to review the Site you are using and this Policy periodically, and to be aware of any modifications. Your continued use of a Site after any such modifications will constitute your; (a) acknowledgment of any modified Policy; and (b) agreement to abide and be bound by any modified Policy. To the extent that any modifications to this Policy materially alters how PIXELPAD.IO will use information collected under prior version of the Policy, PIXELPAD.IO will provide you notice by email using your email on file, and where required by law, will obtain your consent.
- Schools and students:
Children under 13 can’t start an account without permission from an adult at home or at school, and a school may give that permission on behalf of parents. The Sites have no messaging, comments or chat between users. Student information belongs to the student and their school, and we use it only to run the service. We never sell student information, and students are never sent marketing email. Advertising on the Sites is served by Google AdSense to accounts without a paid subscription; we send Google no student information. We notify the school of any breach affecting its students within 72 hours of becoming aware of it.
- Where your data is stored:
PIXELPAD.IO stores the information you share securely with Amazon Web Services (AWS). Connections are encrypted, and access to information is restricted to authorized personnel.
- Artificial intelligence:
PIXELPAD.IO provides two features that employ large language models: an AI learning assistant within the editor, and a project function, prompt_ai(), through which a project may submit text to a model and receive a response. Both are provided through NexusHud, Anthropic and xAI. When you use the assistant, the text you enter, the preceding messages of the conversation and the contents of the project open in the editor are transmitted. When a project calls prompt_ai(), the text the project submits is transmitted. No information identifying you is transmitted by either feature. Conversations with the assistant are retained by NexusHud in the United States and are not deleted when your account is deleted; nothing is retained from prompt_ai(). We do not use data from either feature to train artificial intelligence models. No personal information is required to use the assistant.
